Welcome to Prose Innovations LLC. Prose Innovations LLC (“PROSE” or “we” or “us” or “our”) highly values your privacy. Specifically, these Services include but are not limited to applications such as Prose Daily Planner. Please read and understand this Policy carefully before using our Services so that you can better understand our Services and make appropriate choices. By using the Services, you agree to the collection and use of your personal data as outlined in this Policy.

Who We Are

Prose Innovations LLC, a company established under the laws of Florida, U.S.A., is the controller (or a similar role) who is responsible for handling your personal data under this Policy.

The Data We Collect about You

  1. Email address - to authenticate users seeking to access information online, to facilitate the process of a user joining a collaboration group, and to communicate important customer information.
  2. Screen name - to differentiate users within the same collaboration group.
  3. Device Time Zone - to determine the correct time to push a notification to a device over the internet.
  4. Operating System (OS) - to determine the OS-specific code to run.
  5. Saved user input (e.g. tasks, shopping list) - to offer premium services such as:

Special Categories of Personal Data

Certain categories of personal data, such as details about your race or ethnicity, religious or philosophical beliefs, and so on, are considered more sensitive than other categories of personal data in certain jurisdictions and require a higher level of protection. To clarify, our Services do not collect any types of those special categories of personal data.

How Your Personal Data is Collected

We may collect your personal data through our Services, or by mail, phone, email, or other means you choose to interact with us.

Legal Basis for Collection and Use of Personal Data

Our Services may include links to third-party websites, plug-ins, and applications. Clicking on those links may allow you to visit websites and applications of third parties. Please read the privacy policy of the third-party websites, plug-ins, and applications you visit to know how they collect and use your personal data.

Disclosure

We will not disclose your personal data to third parties unless we have obtained your consent or there are other legal bases for such disclosure. We may engage a data processor (and/or sub-processor) to process your personal data for the purposes in this Policy, in which case we will request the data processor (and/or sub-processor) to keep your personal data in strict confidence and only process data to the extent it is necessary to perform its contractual or statutory obligations. We may disclose your personal data to third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets, in which case the new owners will assume all our rights and obligations in this Policy. International Transfer of Data

Your information, including Personal Data, may be transferred to – and maintained on – computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction. If you are located outside of the United States and choose to provide information to us, please note that we transfer the data, including Personal Data, to the United States and process it there. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer. Prose Innovations LLC will take all the steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.

Data Retention

We will only retain your personal data for as long as reasonably necessary to fulfill the purposes set out in this Policy. We will either delete or anonymize your personal data when it is no longer required to satisfy the purposes set out in this Policy.

Your Legal Rights

You may have certain legal rights in relation to processing your personal data, which may include:

  1. Access right: You may request access to your personal data in our possession. The costs of maintaining certain data are paid for by your membership fees. Thus, once you cease to be a paid subscriber to our Services, some data may be deleted and no longer in our possession.
  2. Rectification right: You may request us to correct your personal data if it is inaccurate.
  3. Erasure right: You may request us to delete your personal data.
  4. Withdrawal of consent: You may withdraw your consent at any time.
  5. Right to complain and report: You have the right to complain to the relevant supervisory authority.

The above rights may only apply in limited circumstances under the applicable law and if we decide not to respond to your claim for the above rights, we will explain reasons.

Your Data Protection Rights under the California Consumer Privacy Act (CCPA)

If you are a California resident, you are entitled to learn what data we collect about you, ask to delete your data, and not to sell (share) it. To exercise your data protection rights, you can make certain requests and ask us what personal information we have about you. If you make this request, we will return to you information as required by law. Please note, you are entitled to ask us to provide you with this information up to two times in a rolling twelve-month period. When you make this request, the information provided may be limited to the personal information we collected about you in the previous 12 months.

  1. To delete your personal information: If you make this request, we will delete the personal information we hold about you as of the date of your request from our records and direct any service providers to do the same. In some cases, deletion may be accomplished through de-identification of the information. If you choose to delete your personal information, you may not be able to use certain functions that require your personal information to operate.
  2. To stop selling your personal information: We don't sell or rent your personal information to any third parties for any purpose. You can request disclosure or deletion at any time.
  3. To correct your personal information

Please note, if you ask us to delete your data, it may impact your experience with us, and you may not be able to participate in certain programs or membership services which require the usage of your personal information to function. But in no circumstances, we will discriminate against you for exercising your rights.

Children’s Data

Our Services are geared towards users at least 13 years of age, and we assume that users are not under the age of 13. If parents or legal guardians suspect that their children, under the age of 13, have provided us with personal data inadvertently, they may request such personal data be removed by contacting us at joseph@dailyplan.pro. Users who are between 13 and 18 years old (or the relevant age defined as a minor in the respective jurisdiction) should seek the consent of their parents or legal guardians before using our Services.

Data Security

Data given to PROSE to store over the internet is safeguarded from unauthorized access by requiring user authentication (i.e. logging in) using widely-accepted standards (e.g. email and password). After authentication, there are additional rules governing the content that each authenticated user may see, which is ultimately determined by each user-author through the settings that they choose in the application. The security of your data is important to us but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.

Changes to this Policy

This Policy may be changed from time to time. If we change anything important about this Policy (e.g., the type of personal data we collect), we will provide a prominent link together with the updated policy for your reference on our Services.
